The Malta Financial Services Authority (“MFSA”) decided to proceed with imposing an administrative penalty of one hundred and thirty-thousand-euro (€130,000) and the issuance of a directive on Investors Europe (Malta) Limited for the breaches of the MiFID Rules and the Investment Services Act (Control of Assets) Regulations.

BREACHES
The MFSA determined that the Company acted in breach of Rule R1-1.8.13, Rule R1-1.5.1.2 and Rule R1-1.5.3.6 of the MiFID Rules and Article 7(11) of the Investment Services Act (Control of Assets) Regulations.
REGULATORY ACTION
On 4 September 2025 the MFSA decided to proceed with imposing an administrative penalty of one hundred and thirty-thousand-euro (€130,000) for the breaches of R1-1.8.13 of the MiFID Rules and Article 7(11) of the Investment Services Act (Control of Assets) Regulations.
The Authority further decided to issue a directive in terms of Article 16 of the MFSA Act and Article 15 of the ISA for the breach of Rule R1-1.5.1.2 and Rule R1-1.5.3.6 of the MiFID Rules:
- Directing the Company to amend its policies and procedures as requested by the Authority in its Report, in order to have effective systems and procedures in place as per the requirements of the ISA and its Rules within six (6) months from its decision.
- The Company is in the interim required to report to the MFSA on a monthly basis the progress of the required amendments to its policies and procedures.
It should be noted that the MFSA’s decision may be appealed before the Financial Services Tribunal within the period as prescribed by the applicable law.
