MFSA Event Photography, Video & Image Release Policy
1. Purpose and Scope
This policy explains how the Malta Financial Services Authority (“MFSA”) takes and uses photographs and video recordings at events it organises or co-organises.
2. Image Capture Authorisation and Release
BY ATTENDING THIS EVENT AND TICKING THE RELEVANT BOX IN THE EVENT REGISTRATION FORM PROVIDED TO YOU:
- you (“You” or “Your”), on Your own behalf, authorise the Malta Financial Services Authority, a Maltese governmental regulatory body and those acting under its permission, (“MFSA” or “We”, “Us”, “Ourselves” or “Our(s)”) to use, reproduce, modify, distribute, make available, store, edit, copy, publish or broadcast on any medium (including but not limited to the Internet, printed matter and any other media), on a world-wide basis, now or at any time in the future, free of charge and without any expectation of compensation or other remuneration of any kind in Your favour, any photographs/images (electronic or otherwise) and/or other reproductions depicting Your image and/or the use of Your name and/or surname, all the above captured/recorded by Us during events co-/organised by Us, and/or as You may have specifically provided to Us and/or shall provide to Us, as well as any additional data collected via the Event Registration Form, (“Material”) in whole or in part (collectively hereinafter referred to as the ‘Purpose’);
- you hereby grant to MFSA all rights of every nature relating to the reproduction, modification and/or use of such Material in connection with the Purpose, and waive, to the fullest extent permitted by law, any rights that You may have in and/or relating to the Material pursuant to any statute or law, including any moral rights You may have in and/or relating to the Material under the Maltese Copyright Act (Cap. 415 of the Laws of Malta). You also waive any right You might have to inspect and/or approve the Material. You understand and agree that upon creation of the Materials (as relevant to the Purpose) they shall become property of MFSA and will not be returned;
- you hereby hold harmless and forever discharge MFSA from all claims, demands, damages and causes of action which You, Your representatives, Your dependants, executors, administrators, or anyone acting on Your behalf or on behalf of Your estate have or may have by reason of this Authorisation and Release. You also agree that this Authorisation and Release shall be binding on Your heirs, successors, executors, administrators and assignees;
- YOU HEREBY DECLARE TO BE EIGHTEEN (18) YEARS OF AGE OR OLDER AND HAVE EVERY RIGHT TO CONTRACT IN YOUR OWN NAME AND DECLARE TO HAVE READ AND UNDERSTOOD THIS POLICY (INCLUDING THE PRIVACY NOTICE BELOW), AND THAT YOU ARE FULLY FAMILIAR WITH ITS CONTENT;
- YOU ALSO HEREBY GIVE YOUR EXPLICIT CONSENT TO MFSA TO PROCESS YOUR PERSONAL DATA (AS FORMING PART OF THE MATERIAL) FOR THE PURPOSE EXPLAINED ABOVE AND IN ACCORDANCE WITH THE PRIVACY NOTICE BELOW.
3. PRIVACY NOTICE – Last Updated on 18.08.2025
We at MFSA take Your privacy very seriously. We strive to process personal data in line with all applicable laws including the EU General Data Protection Regulation (‘GDPR’) and the Maltese Data Protection Act (Chapter 586 of the Laws of Malta).
Why We Need Personal Data
We need Your personal data (the information You are providing to Us in the event registration form and the images/ likeness relating to You that We capture/record/process [or authorise any entity to capture/record on Our behalf] and/or that You may have otherwise provided or shall provide to Us, that identifies You as an individual) in relation to the Purpose as explained above. Therefore, in this case, our legal basis for processing the said personal data is Your consent. However, in the event that You withdraw Your consent when Your personal data are already being processed by Us (for example, once the Material has already been published), or in the case of wide ‘group shots’ which portray several people at once, We shall rely on the legal basis of necessity for the purposes of Our legitimate interest(s) to carry on processing Your personal data to the fullest extent permitted by law. In some cases, for example, when the Material has been published online, it may be impossible for use/retention by third parties to be stopped by Us.
How Personal Data Will be Used in this Matter
We shall use the Material which contains Your personal data (including images depicting You) limitedly for the Purpose as explained above. For the avoidance of all doubt, Your personal data as contained in the Material will be communicated and used internally within MFSA and/or externally via – as an illustrative, yet incomplete example – publication on any MFSA website(s) or social network(s) – such as Facebook, Instagram, X, LinkedIn, YouTube – and/or on other mediums that MFSA may choose to use (e.g. newsletters, notice boards, in printed mediums such as flyers, magazines, books or even advertisements as well as other public fora such as television, newspapers, podcasts and radio), including for promotional reasons. Contact details will be kept confidential unless You consent otherwise.
Who We Share Personal Data With
Your personal data will be made available to those people in Our organisation who need it to carry out their duties in relation to the Purpose outlined above and/or to external data processors acting on Our behalf and/or joint controllers (also in connection with the Purpose) as the case may be. In this particular case, due to the nature of the Material and the Purpose it will be used for, Your personal data (including images depicting You and/or other Material containing Your likeness) may very well be made public (as explained in the paragraphs above). You understand that once the Material is published online, it may no longer be recalled.
How Long We Keep Personal Data For
We will keep Your personal data for as long as necessary for the Purpose or in those instances where We rely on Your consent, until You withdraw Your consent – bearing in mind the perpetual nature of this Policy. In certain cases, We are entitled to retain personal data as opposed to being obliged to do so. Once material is published online, We cannot be held responsible for any use and/or retention thereof by third parties.
Your Rights
You, as a ‘data subject’ as understood under applicable data protection laws, have several rights that are applicable under certain conditions and in certain circumstances, including Your:
- Right of access to Your personal data processed by Us;
- Right to ask Us to rectify inaccurate personal data concerning You;
- Right to have Us erase Your personal data (‘right to be forgotten’);
- Right to ask Us to restrict (that is, store but not further process) Your personal data;
- Right to ask Us to provide Your personal data to You in a structured, commonly used, machine-readable format, or (where technically feasible) to have it ‘ported’ directly to another data controller (‘right to data portability’);
- RIGHT TO WITHDRAW ANY CONSENT You may have given Us AT ANY TIME (for example the consent You are providing Us in the event registration form, although We may have one or more other legal grounds to continue processing, namely, Our legitimate business interests). Withdrawal of consent will not affect the lawfulness of any prior processing;
- Right to object to Our processing of Your personal data (where We process personal data on the basis of the legitimate interests);
- Right to lodge a complaint with the relevant supervisory authority (in Malta’s case, the IDPC – https://idpc.org.mt).
