About Banking Supervision


The Banking Supervision Function at the MFSA is entrusted with the onsite and ongoing supervision of licensed banks and non-bank financial institutions (FIs), as well as their Authorisation. The Function also carries out supervision of Significant Credit Institutions (SIs) together with the European Central Bank through the Single Supervisory Mechanism (SSM). The Policy & Legal Team within Banking Supervision provides policy stances and legal advice, both within the MFSA and to external stakeholders, with a view to the consistent and effective application of the local legislation as well as European Regulations and Directives. The team is also tasked with the transposition and implementation of such EU legislation and guidelines issued by the European Banking Authority.

The Role


This is an exciting opportunity for an advocate specialising in legal regulatory matters within the banking and financial services sector. The Policy & Legal Team of the Banking Supervision Unit at the MFSA, is continuously striving to build a team of individuals with a passion for policy, regulation and compliance in order to further enhance the quality of work and to contribute to the success of the team, as a key player in shaping banking policy for Malta. 

The successful candidate will lead the Legal team and report to the Deputy Head (Policy & Legal) of the Banking Supervision Unit within MFSA and will be expected to provide efficient and professional advice on policy and legal regulatory matters and contribute to the various duties that are undertaken by Banking Supervision, including the following tasks as necessary:

  1. Review and oversee work in the preparation of policy stances, procedures or advice on regulatory issues pertaining to Banking Supervision, and guide the team accordingly;
  2. Advise on the legislative changes required to address gaps in the national legislative framework and oversee and review any legislative amendments required, in transposition/implementation of EU Directives or as otherwise required;
  3. Attend and participate, as a representative of the MFSA, in local and overseas training, meetings and working groups, particularly those relating to the EBA, ECB, ESRB and BIS and other European regulatory bodies, and provide input as required;
  4. Prepare and sign-off internal reports and memoranda submitted to various internal committees such as the Executive Committee and/or Regulatory Committee of the MFSA and follow-up any such actions and decisions taken, accordingly;
  5. Coordinate the work of the Banking Supervision Function on legacy and current cases and work closely with the MFSA's Central Legal Function to prepare written submissions, testimony or witnesses;
  6. Provide on-going advice and guidance to the Function as may be required;
  7. Mentor and manage a dedicated regulatory-focused legal team by adopting a proactive approach to the responsibilities of the team, being responsible for the team's professional development and ensuring that optimal performance is maintained;
  8. Liaise with Senior Management as required to achieve the objectives of the function, including contributing to departmental priorities;
  9. To deputise and provide support to the Deputy Head and Head of Function as may be required;
  10. Other ad hoc related duties as may be required by Senior Management of the Function from time to time and to report on the outcome of such assignments as may be appropriate and necessary.

 

 

About You


The required candidate should have a University of Malta Degree in Law (LL.D or Master of Advocacy Level) or a comparable recognised legal qualification National Qualification Framework Level 6 or better, duly certified by the Malta Qualifications Recognition Information Centre (MQRIC) or a widely recognised professional qualification at a comparable level. Possession of a post graduate degree in a discipline relevant to the financial services sector would be considered an asset.

The applicant should also possess a minimum of eight (8) years working in the area of banking. Candidates with longer working experience relevant to the role will be preferred.
